Terms of Service
These Terms of Service govern your access to and use of the Arkion platform and associated services. By accessing or using Arkion, you agree to be bound by these terms.
Definitions

| "Platform" | The Arkion NHIG software, dashboard, scanner, and APIs |
| "Customer" | The enterprise organisation that has contracted with Arkion |
| "Authorised User" | Individual granted access by the Customer |
| "Discovery Scan" | The read-only infrastructure scan provided free of charge |
| "Governed Estate" | The set of NHIs under active Arkion governance |
| "NHI" | Non-Human Identity — any machine credential, certificate, agent, or API key |
Access and Use
The Platform is provided to enterprise customers under a written agreement. Access is granted to Authorised Users only. Customers are responsible for ensuring Authorised Users comply with these terms.
Arkion reserves the right to suspend access for breach of these terms or non-payment. The Discovery Scan is provided free of charge on a read-only, no-commitment basis.
Acceptable Use
You must not:
- Use the Platform to scan or govern infrastructure you do not own or have explicit authorisation to access
- Attempt to reverse engineer, decompile, or extract source code
- Resell or sublicense access to the Platform
- Use the Platform to process data in violation of applicable law
- Introduce malicious code or attempt to compromise Platform security
- Use automated tools to scrape or extract Platform data
Intellectual Property
Arkion owns all intellectual property rights in the Platform, including the NHIG methodology, scanner architecture, dashboard, APIs, and all associated documentation. These terms do not transfer any ownership to you.
You retain ownership of your infrastructure data and scan outputs generated from your environment.
Data and Privacy
Processing of personal data is governed by Arkion's Privacy Policy (arkion.ai/privacy) and, for customers, the Data Processing Agreement (DPA) incorporated into the customer contract.
By using the Platform, you agree to Arkion's data practices as described in those documents.
Disclaimers and Limitation of Liability
The Platform is provided "as is" for the purposes described in the customer agreement. Arkion does not warrant that the Platform will be uninterrupted or error-free.
To the maximum extent permitted by law, Arkion's aggregate liability under these terms shall not exceed the fees paid by the Customer in the 12 months preceding the claim. Arkion is not liable for indirect, incidental, consequential, or punitive damages.
Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence.
Confidentiality
Each party agrees to keep confidential the other party's non-public information. Arkion will treat your infrastructure data and scan findings as confidential.
You agree to treat Arkion's platform architecture, pricing, and roadmap information as confidential. Confidentiality obligations survive termination for 3 years.
Term and Termination
These terms remain in effect while you use the Platform. Either party may terminate the customer agreement on written notice per the terms of that agreement.
On termination, your access is revoked, and Arkion will delete or return your data per the DPA. Sections relating to IP, liability, and confidentiality survive termination.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
For customers located in the European Union, mandatory consumer protection laws of your country of residence may also apply.
